What happens if my Tenant doesn't pay the Rent?
Contact us and tell us how you would like us to react. As a firm of Bailiffs we are able to provide leverage and our legal knowledge to take steps to recover outstanding rent quickly. If you have already taken steps to work positively with the tenant to obtain payment and payment still remains outstanding, it makes sense to use a Bailiff to collect what is due to you.
In many cases just one Bailiff's visit will make sure that in future the tenant recognises the importance of paying the rent on or before the due date.
Collecting Commercial Rent Arrears
- Why should a Landlord use a Bailiff?
It is easy, quick and free. Also once we have levied, no other Bailiff can levy. This means that if the debtor owes money to others e.g. for Rates, Inland Revenue, VAT etc the debtors goods are secured for the Landlord and any of the Landlords own goods on the property are protected from further seizure.
- How complicated is the procedure?
Very simple, just download and complete a Rent Distress Warrant Form then return it to us either by mail or FAX. We arrange to visit the debtor a.s.a.p. to recover the debt. Phone us and FAX the form for immediate action.
- What is the fee from the Landlord?
NO FEE!!! - this is a completely free service to Landlords. The debtor pays our Bailiffs' fees along with the rent arrears as set out by law.
- How long before action is taken?
We promise to make the first visit to the debtor within 2 working days from the time we receive the completed Warrant. However, in most cases this is done within 24 hours and often on the same day.
- Do we need to go to court?
No - the simple procedure we use is known as 'Landlords Distraint' and is a unique privilege granted many years ago to Landlords. (It is widely used and regulated by the Distress For Rent Rules 1988).
- What is your catchment area?

- What is your recovery success rate?
Over 90%.
- Is the debtor given time to pay?
The Law allows 5 days 'Walking Possession' (which the debtor must pay for) at the Bailiffs discretion. Further time can be secured on the goods subject to re-levies if the Landlord permits. So it's up to you, we will act on your instructions.
- What fees will the debtor incur?
Fees are set by law and lodged with the County Court.
- How do I reacquire my property lease?
If you wish to terminate the lease and re-possess your property, you can read our page about Forfeiture of Lease and Commercial Property Repossession. Please note the law does not allow us to Distrain and take Possession of your Property at the same time, it must be one or the other.
